University Hospitals, Plaintiffs Attorneys File Joint Motion To Extend Statute Of Limitations

University Hospitals and plaintiffs lawyers involved in the UH fertility clinic case have filed a joint motion to propose giving patients who lost eggs and embryos extra time to file lawsuits or negotiate settlements. If approved, the motion would grant an extension of the statute of limitations by one year.

In a written statement released Thursday, UH said the motion “is intended to give patients more time to reach resolution, investigate, and address highly personal issues and choices before proceeding to litigation.”

In March of last year, a storage tank malfunction at UH’s fertility clinic left 4,000 eggs and embryos unviable. More than 70 lawsuits have been filed against the hospital.

Judge Ashley Kilbane, who is presiding over the case, will discuss the motion in a hearing in Cuyahoga County Common Pleas Court next week.
